    2. Scope

    1. These terms apply to all contracts concluded through npole.net between the seller and consumers.
    2. We sell to consumers only, not to businesses.
    3. The contract languages are English, Polish, German, French, Spanish and Italian.

    3. What we sell

    1. Based on the details you provide (your child's name, an optional photo, an optional voice sample and optional text), we create personalised digital products: interactive picture books with narration and short audio samples.
    2. Products are delivered only digitally, as a private link sent by e-mail. Nothing is shipped.
    3. You choose the language of the book in the order form. It does not have to be the language of the website.

    4. Placing an order

    1. The products shown on the website are not a binding offer.
    2. By clicking the order and pay button you make a binding offer. The contract is concluded when the payment is confirmed.
    3. We send an order confirmation to the e-mail address you give. Please keep it, as we do not store the text of the contract separately for you.

    5. Prices and payment

    1. The prices shown at the time of the order apply. They are final prices in the currency shown (GBP, USD or EUR).
    2. Payment is processed by Stripe Payments Europe, Ltd. (card, Apple Pay, Google Pay and other methods shown at checkout). We do not store your card details.
    3. Payment is due immediately when you place the order.

    6. Delivery and access

    1. We send the link to the finished book to your e-mail address, usually within 24 hours (standard) or 3 hours (express) of payment.
    2. Without a subscription, the book is available through the link for 90 days. With an active subscription, access lasts as long as the subscription.
    3. We are not liable for temporary unavailability caused by force majeure, maintenance or outages of third-party services (hosting, AI providers).

    7. Subscription

    1. The subscription renews automatically every month or every year, depending on the plan you choose, and is charged to the payment method you provided until you cancel it.
    2. New subscribers can get the first month of the monthly plan at a reduced introductory price, once per e-mail address. After the first month the regular monthly price shown on the website applies.
    3. You can cancel at any time in your account. Access lasts until the end of the period you have paid for; there are no refunds for the part of the period already started.
    4. The subscription includes the number of free stories per month shown on the subscription page. Unused stories do not carry over to the next month.

    8. Right of withdrawal

Consumers have a statutory right of withdrawal. Details are in the information on the right of withdrawal. For digital content the right of withdrawal ends early if you have expressly agreed that we start before the withdrawal period ends and confirmed that you know you lose the right once the product has been delivered.

    9. Your content

    1. You confirm that you are entitled to upload the photo, voice sample and text, in particular that you have the consent of the person shown or recorded, or of their parent or guardian.
    2. You grant us a non-exclusive right to process and store this content only to create and deliver your order.
    3. We may refuse orders with unlawful or offensive content.

    10. Complaints and warranty

The statutory rights for digital products apply. Please send complaints to info@npole.net. We reply without undue delay, and at the latest within 14 days.

    11. Liability

We are fully liable for intent and gross negligence and for injury to life, body or health. For slight negligence our liability is limited to breaches of essential contractual obligations and to the foreseeable damage typical for the contract.

    12. Use of the products

You receive a simple, non-transferable right to use the personalised products privately and non-commercially, without time limit. Passing them on or using them commercially is not allowed.

    13. Privacy

Information on how we process personal data is in our privacy policy.

    14. Disputes and final provisions

EU consumers can use the EU online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board.

Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of the country where you live remain unaffected. If any provision is invalid, the rest remain valid.
